About Partition Deed

A Partition deed is the legal document drafted and executed at the time of the division of common property. A partition deed is mostly used by families, to divide members’ shares in inherited properties. After the division through the partition deed, each member becomes the independent owner of his share in the property and is legally free to sell, rent or gift his asset, according to his wishes.

Important Points/Key Elements to be considered:

  1. Parties
  2. Title of the Parties
  3. Share to be allotted by metes and bounds to each person should be mentioned, else the property gets equally divided among the members.
  4. Description of Property
  5. Stamp and registration charges
  6. Clause stating that after executing the partition deed, no individual shall have any right on the property other than the share allotted to him/her.
